Judge Recommends Wrongful Death Claims in Theater Shootings Tossed

U.S. Magistrate Judge Michael Hegarty, in an order issued Thursday, said that Colorado law prevents people wounded in the Century Aurora 16 movie theater shooting as well as family members of those who were killed from bringing claims of negligence and wrongful death case against Cinemark USA.

According to Hegarty, claims alleging violations of the Colorado Premises Liability Act could go forward.

“So long as a person alleges injury that occurred on the property of another … the claim must be brought solely under the CPLA,” Hegarty wrote.

After the shooting, in which 58 people were wounded, several people who were injured and the family members of four of those killed sued Cinemark blaming the theater’s lax security.
