Premises Liability

The term premises liability covers all types of accidents or injuries that may occur at a business or on private property. In the state of Florida, it is required that all businesses or private property owners (including residences) are responsible for keeping their properties safe for the people who visit the premises.

Premises Liability claims can include: slipping accidents, tripping accidents, objects falling from shelves, and even incidents involving assault, rape, robbery, or murder on the premises. According to Florida Law, stores, restaurants, and business owners must keep their premises safe to prevent harm to their customers or visitors. The owner or operator is legally responsible for the injuries of another person if:

  • The property owner created a dangerous condition.
  • The property owner was aware of a dangerous condition and did not fix it.
  • The property owner failed to do inspections which would have fixed a dangerous condition prior to the accident.

If you or someone you know or love has been injured because a property owner failed to maintain the property and keep it safe, you may be entitled to be compensated to enable you to recover damages for medical expenses, loss of wages, pain and suffering, disfigurement, disability and the inability to maintain a normal life.
